CONDITIONS OF SALE
 
  1. Definitions
 
1.1 “Conditions” means the terms and conditions of sale set out in this document and any special terms and conditions agreed by Securitex CCTV Ltd.
 
1.2 “Customer” means the person or persons placing the order but does not include any subsequent purchaser or end user of the goods.
 
1.3 “Securitex” means Securitex CCTV Ltd, Company Registration No 6749805.
 
1.4 “Goods” means the articles which the customer agrees to buy from Securitex or any service which Securitex undertakes to provide to the customer.
 
        1.5 “Price” means the price for the goods excluding carriage, packing, insurance and VAT.
 
1.6 “Website” means www.securitexcctv.com
 
  1. Conditions Applicable
 
         2.1 These conditions shall apply to the supply of goods and services by Securitex to the customer to the exclusion of all other terms and conditions which the customer may purport to apply under any purchase order, confirmation of order or similar document.
 
         2.2 All orders for goods shall be deemed to be an offer by the customer to accept the goods  pursuant to these conditions.
 
2.3 Acceptance of delivery of the goods shall be deemed conclusive evidence of the customer’s acceptance of these conditions.
 
2.4 Any variation to these conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by Securitex.
 
  1. Pricing & Payment
 
3.1 All prices quoted exclude Delivery and VAT unless otherwise stated. The price charged shall be that applicable at the date of dispatch of the goods.
 
        3.2 Payment of the price, delivery and VAT shall be due prior to despatch of the goods, or, where Securitex is installing equipment, in full upon completion of said installation. All goods remain the property of Securitex until paid for in full. Time for payment shall be of the essence.
 
3.3 If the customer fails to accept delivery, Securitex shall be entitled to charge the customer for any additional costs incurred.
 
 
  1. Delivery
 
4.1 Whilst Securitex will strive to adhere to any agreed delivery dates, the customer acknowledges that these dates are not guaranteed and agrees that Securitex shall not be liable for any costs or losses arising from any delay in shipment or delivery.
 
  1. Warranty
 
        5.1 Securitex warrants that goods supplied by them will correspond with the specification of said goods as advertised on the website. Goods supplied by Securitex are covered by a 12 months manufacturer’s warranty for defects in material or workmanship, with the following exceptions, CCD Chips. This warranty begins upon the date of delivery of goods to the customer.
 
5.2 This warranty is given by Securitex subject to the customer notifying Securitex in writing within seven days of any defect becoming apparent in the goods and the customer returning the defective goods carriage paid to Securitex.
 
5.3 No representation or warranty is given as to the suitability or fitness of the goods for any particular purpose and it is the customer’s responsibility to satisfy himself in this respect.
             
        5.4 No warranty claim or refund of any kind will be considered where goods returned by the customer have had cables cut or have been modified in any way
 
        5.5 All other warranties, conditions or terms relating to fitness for purpose, quality or condition of the goods whether express or implied by statute or common law or otherwise are excluded to the fullest extent permitted by law.
 
 
  1. Faulty Goods
 
        6.1 The customer acknowledges that Securitex is not responsible for any consequential loss or liability to them or which the customer may have to subsequent purchasers or end users of the goods, and the maximum liability of Securitex in any circumstance shall be limited to a refund of the price paid by the customer for the defective goods.
 
        6.2 In the event of goods becoming defective due to faulty materials or workmanship within the warranty period as set out in clause 5.1, the customer must obtain a Returns Authorisation Number from Securitex prior to returning the goods. Securitex will not accept goods returned without a Returns Authorisation Number under any circumstance.
 
6.3 In the event of goods becoming defective as in clause 5.2, the customer will only be entitled to return the defective goods only, for example if the customer had purchased the goods as part of a set, only the defective goods can be returned.
 
 
  1. Digital Video Recorders (DVR’s)
 
7.1 Where a customer purchases a DVR which can be accessed over the internet, the customer acknowledges that Securitex are not responsible for networking the DVR. It is the responsibility of the customer to ensure that they have the technical expertise or consult a qualified I.T. technician for this purpose.
 
 
  1. Limitation
 
8.1 Securitex shall not be liable for any consequential loss or indirect economic loss or damage whether arising in contract, tort or otherwise in connection (directly or indirectly) with the goods.
 
 
  1. Force Majeure
 
9.1 If the usual operation or distribution of Securitex is interrupted by lock-out, strikes, fire or any cause beyond it’s control Securitex may suspend or cancel delivery.
 
  1. Proper Law
 
10.1 English Law shall be applicable to these conditions of sale.
